PREAMBLE

These terms and conditions rule the contractual relationship between Adega Cooperativa de Mangualde, CRL with headquarters in Quinta do Melo, 3530-250 Mangualde, hereinafter referred to as "Online Shop of Mangualde’s Winery" and, on the other hand, people who wish to make a purchase through the website of Mangualde’s winery www.acmang.com, hereinafter referred to as "client". In case of omission of any condition, it shall be considered ruled by the uses and customs in the sales by distance sector according to the rules of the Code of Ethics and Legal Practice of AMD - Portuguese Association of Direct Marketing.

OBJECT

These conditions are intended to define the general conditions of sale established between the Online Shop of Mangualde’s winery and the client such as: access to the site, the order act, the method of payment and products delivery terms.

The Online Store of Mangualde’s winery reserves the right to unilaterally modify at any time and without notice, the presentation and configuration of the website, the product catalog and the conditions required to access and / or use the Website.

CONDITIONS OF ACCESS AND USE OF THE WEBSITE

Access to the Online Shop of Mangualde’s Winery is free and does not require prior subscription or user registration. Alcoholic beverages available for sale in the Online Shop of Mangualde’s Winery can only be purchased by individuals who have the legal age to do so, in their country of residence.

OBLIGATIONS OF CUSTOMERS AND USERS

The client undertakes to make diligent use and to keep secret his access code and username to access the site or services. The client is responsible for damages and losses of any nature that the Online Shop of Mangualde’s Winery may suffer as a result of a breach of an obligation that is submitted by the legal notices.

PRIVACY AND PROTECTION OF PERSONAL DATA

The collected data in the Online Shop of Mangualde’s Winery are for the processing of orders and communication with customers, requests for information, statistical analysis, and the respective use for direct marketing purposes.

The customer authorizes the Cooperative Winery of Mangualde to send information on products and services that may be of interest using their personal data for direct marketing purposes via any channel of communication, including the use of e-mail, SMS or other forms of automatic call. The Cooperative Winery of Mangualde guarantees the confidentiality of any data supplied by its customers. All clients have the right to access, rectify and cancel their data. The Online Shop of Mangualde’s Winery does not guarantee the availability and continuity of the website and the services and excludes all liability for damages of any kind that may be due to the lack thereof. The Online Shop of Mangualde’s Winery reserves the right to refuse or withdraw access to the website or the services at any time and without notice, either by themselves or a third party, to those users who do not comply with these legal notices or applicable particular conditions. 

ONLINE ORDER

To make a purchase in the Online Shop of Mangualde’s Winery the customer must select the desired products and access his shopping cart. The client must follow all the steps so that the order is successfully completed. The purchase order validation assumes that the client took notice and accepts the general conditions of contract and use of the site. The data recorded by constitute proof of the transaction set made between Online Shop of Mangualde’s Winery and the client. The Online Shop of Mangualde’s Winery reserves the right to change any description, image or other catalog information from the online shop without notice. 

PRODUCT AVAILABILITY 

The Online Shop of Mangualde’s Winery honors orders received online only within the limit of available stocks, pledging to deliver the ordered goods as soon as possible. If the product is not available, Online Shop of Mangualde’s Winery is committed to timely inform the client. The Online Shop of Mangualde’s Winery only does dispatch on working days. Thus, the weekends or holidays are not considered for estimated delivery charges.

PRICES

The prices of the products presented in the Online Shop of Mangualde’s Winery include VAT to applicable taxes under Portuguese law. Any modification of VAT type will be reflected in product prices. After that date, prices may be modified at any time. All prices available in the shop may be changed without notice and are always subject to stock rupture. Promotions that run in the online shop are not applied in the physical Shop of Mangualde’s winery. Dispatch costs are paid by the customer and is calculated according to the weight of the products, the destination and the total value of the order.

DISPATCH COSTS

The dispatch cost is calculated according to the weight of the products, the destination and the total value of the order. This value is indicated in the shopping cart before the final validation of the order. The delivery is free for orders worth more than € 60 in Continental Portugal.

PAYMENT METHOD

The payment method available at the Online Shop of Mangualde’s Winery is the payment by ATM reference. After validating the order, the client receives a message in his email box with the data to make the payment at a cash machine. The Online Shop of Mangualde’s Winery use its efforts to ensure maximum confidentiality and security of data sent over the internet.

DELIVERY

Orders will only be sent after confirmation of payment and stock. The order delivery will be made to the address given by the user and according to the carrier's delivery schedules.

Home delivery can not be made to PO Boxes. Delieveries abroad may be made as long as the address is covered by the carrier's delivery area. The Online Shop of Mangualde’s Winery undertakes to deliver the ordered products as soon as possible. All orders issued by the Online Shop of Mangualde’s Winery should be examined by the customer upon receipt. If detected any irregularities or damage of the product, the customer must return it to the shipper, justify the reason for the returning the product and immediately inform the Mangualde’s Winery. All deliveries made out of mainland Portugal are accompanied by the Accompanying Administrative Document (AAD).

RETURNS

Online Shop of Mangualde’s Winery allows the return of the product within 14 days of its acquisition in accordance with the Portuguese Decree-Law No. 143/2001 and Decree-Law 82/2008 of 20/5. However, upon return, the product must remain intact (including packaging accompanying the product and front and back labels); otherwise, the return is without effect.
